S-Conn Handels GmbH for audiovisual and telecommunications products is the contractual partner for all transactions that the customer concludes with us via our shop www.s-conn.de.

§ 1 General
The following terms and conditions and information are written in German. Upon request, they can be requested by telephone at the above-mentioned telephone number or email address in digital or written form. They will also be sent to the customer after the purchase has been completed.
Our address for service can be found in particular on the invoice and in the imprint, as well as in these General Terms and Conditions.
The following General Terms and Conditions apply to all our deliveries from contracts concluded via our offer at www.s-conn.de. The buyer's general terms and conditions only apply insofar as we have expressly agreed to them. In all other respects, the statutory provisions apply. In all other respects, the statutory provisions apply unless otherwise agreed.
Our offer is directed exclusively at dealers and end consumers who use the goods in their independent professional or commercial activities or in their official or official capacity. Sales to private end consumers are excluded. The purchase requires registration, during which we verify the characteristics of the purchaser.

From a legal perspective, the products presented on www.s-conn.de constitute invitations to the customer to submit a binding offer to www.s-conn.de. The customer therefore submits a binding offer by sending their order. They will then immediately receive, within 24 hours, an email from www.s-conn.de stating whether www.s-conn.de accepts the contract offer. In the event of acceptance, the message contains a summary of the contract content and the General Terms and Conditions and, if advance payment has been agreed, Payment information. A contract is then concluded. In the event of rejection, no contract is concluded. No contract is concluded if www.s-conn.de does not confirm acceptance of your offer by email within 24 hours.

(b) Technical
From a technical perspective, a contract is concluded as follows:

First step:
The customer must register in order to use the functions on the offer pages and place orders.
Once you have completed your registration and we have approved your account, the process continues as follows:

The customer clicks on the “Add to cart” button on the product description pages. The subject matter of the contract and the final price plus shipping costs are then displayed. Here, they can decide (button) whether they want to “continue shopping,” i.e., return to the shop, or “proceed to checkout” and continue processing and submitting their order. They can also change the quantity of goods to be ordered or remove individual or all items and then click on “update.” The changed conditions will then be displayed.
Here, the customer can already select the country (exhaustive list; shipping costs are shown in the calculation) and the desired payment method.

Second step:
Here, the customer must log in (if they have not already done so). Here, you also declare whether you agree to our terms and conditions and privacy policy or the storage of data. Here, you can also decide whether you would like to subscribe to the newsletter (unsubscription possible at any time). Registration is carried out using the double opt-in procedure.

Third step:
A summary will appear here. You have the option to place the order with or without changes (“order with obligation to pay”) or to reject it. You will then receive an email at the address you provided, in which we will explain whether we accept your contract offer or not.

2. After purchase; storage of the contract text
The contract text is stored by www.s-conn.de. Immediately upon receipt of the declaration of acceptance by email, the customer will receive all data relevant to the purchase and a summary of the services ordered, as well as the terms and conditions and information provided here and, if advance payment has been agreed, a request for payment with details of the bank account. The invoice will be sent to the customer separately. www.s-conn.de requests that all print out all information and keep it in a safe place, and to keep the invoice for ten years. The customer will not be able to access the contract data beyond this. We will be happy to send the contract data again by email at the customer's request.


§ 3 Prices
The prices stated in the offer descriptions are exclusive of statutory VAT plus shipping costs.


§ 4 Retention of title
1. The goods delivered by us remain our property until all claims against the customer, now or in the future, have been fulfilled. Our claims are not extinguished by inclusion in a current account balance and its recognition. The customer must store the goods subject to retention of title properly, insure them adequately at his own expense, and provide us with proof of this upon request.
2. The customer is entitled to resell the goods delivered under retention of title to third parties in the ordinary course of business. In this case, however, the customer assigns to us all claims arising from a resale to its customers or third parties up to the amount of our total claim against it, irrespective of whether the goods subject to retention of title have been resold without or after processing by the customer. the goods subject to retention of title have been resold without or after processing by the customer. We hereby accept the assignment. The customer remains authorized to collect this claim from customers or third parties even after the assignment. However, our authority to collect the claim ourselves remains unaffected by this. However, we undertake not to collect the claim as long as the customer meets its payment obligations from the proceeds received, is not in default of payment and, in particular, no application has been made to open insolvency proceedings against its assets or it has suspended payments on its part. Should this be the case, we may demand that the customer immediately provide us with a list of all claims assigned to us, naming the respective debtors, and we would then be entitled to disclose the assignment of claims to those debtors.


§ 5 Delivery time, shipping costs, delivery area, shipping risk
Unless expressly stated otherwise, shipping will take place within 1-3 days. If advance payment has been agreed, the period begins upon receipt of payment. The shipping costs can be found on the “Shipping Conditions” page. The costs are also shown in step 1 of the order in the shopping cart together with the other amounts. Partial deliveries are permitted. Goods that are temporarily out of stock are automatically marked as backordered and delivered at a later date, unless the buyer expressly objects to this. If the total value of the backorders is EUR 50.00 or more, the subsequent delivery will be made without charging shipping and packaging costs. For backorders with a value of less than EUR 50.00, shipping and packaging costs will be charged. For subsequent deliveries abroad, shipping and packaging costs will be charged in all cases. For shipments outside the EU, additional customs costs will be incurred, which must be borne by the recipient. The delivery area can be found on the “Shipping Conditions” subpage. Orders from other countries will not be accepted. The list is exhaustive. The risk of shipment is transferred to the buyer as soon as we hand over the goods to the transport company.


§ 6 Information and regulations regarding warranty periods
1. The provider's warranty is based on §§ 434 ff. BGB (German Civil Code). The warranty rights include the right to subsequent performance (repair or delivery of a new item), withdrawal, reduction and compensation as well as reimbursement of useless expenses. The right to choose between the different forms of subsequent performance is excluded for the customer.

2. Information and regulations for entrepreneurs as end customers
For entrepreneurs as end customers, the warranty period for new goods is 1 year, beginning with the handover. The warranty is excluded for used goods. In the cases of §§ 438 I No. 2, 634a I No. 2 BGB (German Civil Code) and in all other cases the statutory limitation period applies.

3. Notwithstanding the provisions of paragraphs 1 and 2, the following applies with regard to the right to assert claims for damages:
This right applies without limitation to damage to life, limb, and health resulting from a negligent or intentional breach of duty by the seller, its legal representatives, or its vicarious agents, or to damage for which liability exists under the Product Liability Act. The user shall only be liable for other damages if the damages are based on a grossly negligent or intentional breach of duty by the user or by legal representatives or vicarious agents employed by him. In the event of malice on the part of the seller, there shall be no limitation of liability.


§ 7 Note on the law governing the placing on the market, return, and environmentally sound disposal of electrical and electronic equipment (ElektroG)
If you purchase electrical equipment as an end user, you are obliged to dispose of it properly. Disposal in household waste is prohibited, as the materials contained therein are to be recycled and some are also toxic. You can return devices to us or your local collection point free of charge for disposal after use, or send them to us. In the case of large appliances, we are only obliged to accept the old appliance if you purchase a new appliance that serves the same purpose. For small appliances, this obligation applies regardless of whether you are our customer or not. Small appliances are defined as those whose longest edge does not exceed 25 cm. We will cover the postage costs for shipping small appliances.

You can recognize old appliances within the meaning of the ElektroG by the symbol of a crossedout trash can.


§ 9 Final provisions
The contract language is German. The law of the Federal Republic of Germany applies. The place of jurisdiction is
